Citycabpanama.com (“Citycabpanama” or “we” or “our”) headquarter is in Panama city. Described below is the agreement (“Agreement”) between the user (“you”, “your”) and Citycabpanama and it outlines the terms and conditions applicable to the services available through Citycabpanama.com sites (“Site”). This Agreement describes your responsibilities and, among other things, limits the liability of Citycabpanama.
BEFORE USING ANY OF CITYCABPANAMA SERVICES, PLEASE READ ALL OF THIS AGREEMENT, AND OUR PRIVACY POLICY, CAREFULLY. 
By accessing, using or obtaining any content, products, or services through this website, you agree to be legally bound without limitation and abide by these terms and conditions. If you do not accept all of these terms, do not use this Site.
Citycabpanama reserves the right, in its sole discretion, to amend, modify, or alter this Agreement at any time by posting the amended terms on this Site. We recommend that you review these terms and conditions periodically. The amended terms shall be effective from and after the date that they are posted on the Site. This Agreement may not otherwise be amended by you.
You may not use this site for any purpose that is unlawful or prohibited by this agreement and./or any applicable additional terms, without limitation of any other provisions of this Agreement.  Your access to this site may be terminated immediately in Citycabpanama sole discretion, with or without notice, if you fail to comply with any of the provisions of this Agreement.
These Terms govern your use of all Content, Products or Services available through the Site. You agree to be bound by these Terms, and to use the Site in strict compliance with all applicable laws, rulings and regulations, and in a manner that does not negatively reflect on the goodwill or reputation of Citycabpanama and its suppliers and information providers.
Children
Persons under the age of 18 are not eligible to register for, use or Purchase the Products or Services available on the Site.
Responsible party
You are responsible for maintaining the secrecy of your Member ID and password. This is essential to protect the confidentiality of any information that may be stored in our database. In addition, you will be financially accountable for all use of our Site by you and anyone using your password and login information.
General Terms
Citycabpanama grants you a limited, personal, nontransferable, non-sub-licensable, revocable license to access and use the Site only as expressly permitted in these Terms. Except for this limited license, we do not grant you any other rights or license with respect to this Site; any rights or license not expressly granted herein are reserved. Unless we have granted you permission in advance and in writing, you may use the Site only for your personal, non-commercial use, and not to provide services to a third party.
All content included on this Site (“Content”) are intellectual property and copyrighted works of Citycabpanama and/or its third-party providers. Reproduction or storage of information or works retrieved from this Site, in all forms, at any time is subject to the Panama Copyright Act of DERECHOS DE PROPIEDAD INTELECTUAL-LEGISLACIÓN NACIONAL - PANAMÁ Ley de Derechos de Autor y Derechos Conexos - Ley No. 15 del 8 de agosto  de 1994 and all applicable international copyright treaties and conventions, including without limitation, the Berne Convention and the Universal Copyright Convention.
"CITYCABPANAMA”, “CITYCABPANAMA.COM" are registered service marks of CITYCABPANAMA or of another authorized third-party. The use on this Site of any name, trade name, trademark, service mark, logo, symbol or other proprietary designation or marking of or belonging to any third-party, should not be construed as an endorsement or sponsorship of this Site by any such third-party, or the participation by such third-party in the offering of goods, services or information through this Site.
Access to certain areas of the Site is only available to registered members. To become a registered Member, you are required to answer a limited number of mandatory questions. Answers to additional questions are optional. You represent and warrant that all information you supply to us about yourself and others, including email addresses, is true, valid and accurate, and that you have the right to supply us with such information.
Termination
Citycabpanama, in its sole discretion, may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of our Site, even if access continues to be allowed to others. Upon such termination or suspension, you must immediately discontinue use of the Site, and destroy any copy you have made of any portion of the Site. Accessing the Site after such termination, suspension, or discontinuation shall constitute an act of trespass. Citycabpanama shall not be responsible to you to such suspension or termination.
Privacy Policy
As part of this Agreement, You confirm that you have read our Privacy Policy and agree with it as satisfactory to you. Citycabpanama makes no representation or warranty with regard to the Privacy Policy and will be responsible for any actual or consequential damages that result from a lapse in compliance with the Privacy Policy.
Fees
Citycabpanama may charge a fee for the service it provides when you purchase, book or reserve Ground Transportation services through the Site. Any such service fee is non-refundable. In addition, you will be responsible for all charges, fees, duties, taxes, and assessment arising out of your use of the Products and Services available from the Site.
Disclaimer of Warranties
All content included and available on this Site is provided on a “best effort” but “as is” basis. Citycabpanama MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED ON THIS SITE TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE SITE DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR SATISFACTORY WORKMANLIKE EFFORT, INFORMATIONAL CONTENT, TITLE, OR NON-INFRINGEMENT OF THE RIGHTS OF THIRD PARTIES. THE SITE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS THAT THIS SITE WILL OPERATE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE AND/OR ITS SERVERS WILL BE FREE OF VIRUSES AND/OR OTHER HARMFUL COMPONENTS. 


THE SITE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING SUITABILITY, AVAILABILITY, ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY MATERIAL OF ANY KIND CONTAINED WITHIN THIS SITE FOR ANY PURPOSE, INCLUDING SOFTWARE, PRODUCTS, SERVICES, INFORMATION, TEXT AND RELATED GRAPHICS CONTENT.
THE SITE IS NOT RESPONSIBLE FOR ANY FAILURES CAUSED BY SERVER ERRORS, MISDIRECTED OR REDIRECTED TRANSMISSIONS, FAILED INTERNET CONNECTIONS, INTERRUPTIONS IN THE TRANSMISSION OR RECEIPT OF VOUCHER OR, ANY COMPUTER VIRUS OR OTHER TECHNICAL DEFECT, WHETHER HUMAN OR TECHNICAL IN NATURE.
WITHOUT LIMITING THE FOREGOING, NO WARRANTY OR GUARANTEE IS MADE (I) REGARDING THE ACCEPTANCE OF ANY REQUEST, (II) THAT A USER WILL RECEIVE THE LOWEST AVAILABLE PRICE FOR GOODS AND/OR SERVICES AVAILABLE THROUGH THIS SITE, (III) REGARDING THE AVAILABILITY OF PRODUCTS AND/OR SERVICES THROUGH THIS SITE OR, WHERE APPLICABLE, AT ANY PARTICIPATING RETAILER OR RETAILER LOCATION, OR (IV) REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THIS SITE.
Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CITYCABPANAMA INCLUDING ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS, SUPPLIERS, LICENSORS, AGENTS OR OTHERS INVOLVED IN CREATING, SPONSORING, PROMOTING, OR OTHERWISE MAKING AVAILABLE THE SITE AND ITS CONTENTS (COLLECTIVELY THE "CITYCABPANAMA  PARTIES"), BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, COMPENSATORY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: (I) LOSS OF GOODWILL, PROFITS, BUSINESS INTERRUPTION, DATA OR OTHER INTANGIBLE LOSSES; (II) YOUR INABILITY TO USE, UNAUTHORIZED USE OF, PERFORMANCE OR NON-PERFORMANCE OF THE SITE; (III) UNAUTHORIZED ACCESS TO OR TAMPERING WITH YOUR PERSONAL INFORMATION OR TRANSMISSIONS; (IV) THE PROVISION OR FAILURE TO PROVIDE ANY SERVICE; (V) ERRORS OR INACCURACIES CONTAINED ON THE SITE OR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE; (VI) ANY TRANSACTIONS ENTERED INTO THROUGH THIS SITE; (VII) ANY PROPERTY DAMAGE INCLUDING DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS, DURING OR ON ACCOUNT OF ACCESS TO OR USE OF THIS SITE OR ANY SITE TO WHICH IT PROVIDES HYPERLINKS; OR (VIII) DAMAGES OTHERWISE ARISING OUT OF THE USE OF THE SITE, ANY DELAY OR INABILITY TO USE THE SITE, OR ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SITE. THE LIMITATIONS OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
Further, to the extent permitted by law, Citycabpanama Parties accept no responsibilities for any damage and/or delay due to Provider cancellations, shortages, sickness, pilferage, labor disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism or causes beyond the Citycabpanama Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Citycabpanama Party shall be responsible for any Provider's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Citycabpanama Party be responsible for any other wrongdoing of a Provider (including any liability in tort), as to any products and/or services available through this Site. No Citycabpanama Party shall be responsible for any Provider's failure to comply with this Agreement nor for any Provider's failure to comply with applicable country, provincial and local law.
If, despite the limitation above, Citycabpanama Party is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then Citycabpanama and the Citycabpanama Parties' liability will in no event exceed, in total, the sum of US$100.00. Some provinces do not allow the limitation of liability, so the limitations above may not apply to you.
Indemnification
You agree to defend and indemnify Citycabpanama, Citycabpanama Parties, and/or their respective providers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought (i) by you or on behalf in excess of the liability described above; or (ii) by third parties as a result of:
a. your breach of this Agreement
b. your violation of any law or the rights of a third party; or
c. your use of this Site.
Third Parties
If you use this Site to on behalf of a third-party ("Third-party"), you must inform the Third-party of our Privacy Policy and this Agreement and you are responsible for any error in the accuracy of information provided in connection with such use. Each User using this Site for or on behalf of a Third-party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third-party's or the User's failure to fulfill any of its obligations as described above. You are directly responsible for any Request submitted including for total charges and performance obligations.
Customer Service
While Citycabpanama pride itself with high customer service, we will use in good faith, efforts to respond to Requests within the time periods indicated on this Site, no guarantee is made that the status of your Request will be made available to you within the stated processing time. None of Citycabpanama Parties is responsible for any errors or delays in responding to a Request including, without limitation, error or delays in responding to a Request caused by an incorrect e-mail address or other data provided by you or other technical problems beyond their control.
Electronic Notification
To the extent that we need to contact you, you agree that we may do so via any electronic means, including but not limited to communications posted on this Site or electronic mail.
Ground Transportation Service Limitation of Liability
THE GROUND TRANSPORTATION SERVICE  (“GTS”) PROVIDERS OR OTHER SERVICE PROVIDERS THROUGH THE SITE (COLLECTIVELY, “PROVIDER” or “PROVIDER”) ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF THE CITYCABPANAMA PARTIES. TO THE EXTENT PERMITTED BY LAW, THE CITYCABPANAMA PARTIES DO NOT ASSUME LIABILITY FOR ANY INJURY, DAMAGE, DEATH, LOSS, ACCIDENT OR DELAY DUE TO AN ACT OR OMISSION OF A PROVIDER, INCLUDING, WITHOUT LIMITATION, AN ACT OF NEGLIGENCE OR THE DEFAULT OF A PROVIDER, OR AN ACT OF GOD. FURTHER AND TO THE EXTENT PERMITTED BY LAW, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY DAMAGE AND/OR DELAY DUE TO SICKNESS, PILFERAGE, LABOR DISPUTES, BANKRUPTCY, MACHINERY BREAKDOWN, QUARANTINE, GOVERNMENT RESTRAINTS, WEATHER, TERRORISM OR CAUSES BEYOND THE CITYCABPANAMA  PARTIES' CONTROL. NO RESPONSIBILITY IS ACCEPTED FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, FAILURE TO MAKE CONNECTIONS,RE-ROUTING OR ACTS OF ANY GOVERNMENTAL AUTHORITY.
Ground Transportation Service Restrictions
The following Ground Transportation Service Restrictions (“GTSR”) shall apply to a voucher ("Voucher") issued by Citycabpanama or Paypal bill of sale to you in connection with a GTS operated by the Provider of such GTS. You shall be deemed to have the authority to act on behalf of and to bind the person named on the Voucher to the GTS. Acceptance or usage of a Voucher shall be deemed as the acceptance by You and the person named on the Voucher to these GTS restrictions.
i.  A Voucher, when issued by Citycabpanama and presented to the GTS Provider, shall entitle the person named on the Voucher, subject to these GTSR, to use the Ground Transportation described in the Voucher. The Provider will verify the identity of the person named on the Voucher prior to accepting the Voucher; and may require a signature from such named person. The person named on the Voucher will be required to present a government-issued photo ID to the Provider. Admission to the GTS will be denied if the Voucher and a matching photo ID are not provided to the Provider Operator.
ii.  A Voucher will be valid only on the dates indicated on the Voucher and shall expire on the later of those dates. A Voucher may not be redeemed outside of the dates indicated on the Voucher.
iii.  Upon issuance of a Voucher by Citycabpanama, Your credit card shall be charged for the full amount immediately. The total price charged will include all taxes and fees. Unless otherwise indicated on the voucher, Gratuities and incidental charges, such as parking, airport fees, and tolls, are not included.
iv.   A Voucher is valid for redemption only by the person named on a Voucher. A Voucher has no cash value and cannot be assigned, or transferred, in whole or in part.
v.The issuance of a Voucher by Citycabpanama is final. There are no refunds, credits, exchanges, or cancellations of a Voucher once it has been issued by Citycabpanama. A Voucher is like cash - a destroyed, lost or stolen Voucher cannot be reprinted, reissued or refunded. A Voucher may be redeemed only once and only by the Provider. Before purchasing a Voucher, You should confirm that the information that a Voucher contains in is accurate.
vi.   A GTS may not be appropriate for all ages or for individuals with certain medical conditions. Usage of a GTS may be subject to codes, rules or regulations (collectively, "GTS Rules") established by the Provider. Failure to comply with such Attraction Rules may result in denial of admission to or removal from the GTS. Other restrictions, terms and conditions may apply. You should contact the Provider Operator for details.
vii.   Citycabpanama is not responsible for any technical, printing, typographical or other errors associated with the description, depiction, availability, or pricing of a GTS. Availability and price quotations for a GTS are subject to change without notice until a Voucher has been issued. Prices listed on a Voucher are per person, unless otherwise specified.
viii.  GTS availability may change after a Voucher is issued. When Citycabpanama is informed in advance of a significant change to the availability of a GTS, Citycabpanama will use reasonable efforts to notify You. In the event a GTS is canceled, rescheduled or postponed by the Provider, You should immediately contact Citycabpanama.
ix.   Citycabpanama reserves the right to modify and otherwise change these GTSR at its own discretion. Except as provided for in the preceding sentence, no amendment, modification or waiver to these GTSR shall be binding on Citycabpanama unless made in writing and signed by an authorized officer of Citycabpanama.
x.The Provider is an independent contractor of a GTS consolidator. The GTS consolidator is an independent contractor of Citycabpanama. The Provider or the GTS consolidator, and their owners, operators, contractors, and employees are not agents or legal representatives of Citycabpanama for any purpose and have no authority to act for, bind or commit Citycabpanama. The Provider, and its owners, operators, contractors and employees are solely responsible for the use and operation of the GTS, and all actions or events occurring prior to, during, at or after, the GTS.
xi.   YOU ACKNOWLEDGE THAT THE USE OR ENJOYMENT OF THE GTS MAY BE HAZARDOUS AND INHERENTLY RISKY, AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND THE PERSON NAMED ON THE VOUCHER WILL ASSUME ALL RISK OF INJURY OR DEATH ARISING OUT OF OR IN CONNECTION WITH THE USE AND OPERATION OF THE GTS, AND ALL ACTIONS OR EVENTS OCCURRING PRIOR TO, DURING, AT OR AFTER, THE GTS.
xii.   TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITYCABPANAMA SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURY OR DEATH; LOST, STOLEN, DAMAGED OR DESTROYED PROPERTY; OR OTHER LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE USE AND OPERATION OF THE GTS, AND ALL ACTIONS OR EVENTS OCCURRING PRIOR TO, DURING, AT OR AFTER, THE GTS.
xiii.   These GTSR constitute the entire and only understanding between the parties, and replace any prior understandings or agreements (whether oral or written) relating to the subject matter hereof. The failure of Citycabpanama to exercise any of its rights, shall not be construed as a waiver or relinquishment of the future performance of any of its rights, and Your obligations with respect to such future performance shall continue in full force and effect.
Disputes
The laws of Panama City (Panama republica de Panama), without regard to its conflict of law rules, will govern these Terms. The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms and Conditions. If you take any legal action relating to your use of our site or these Terms, you agree to file such action only in the Panama courts in Panama City Panama. In any such action or any action we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to costs, both taxable and non-taxable, and reasonable attorneys' fees
General
Your acceptance of these Terms, and your use of the Site do not create a joint venture, partnership, employment, or agency relationship with us. You may not assign, delegate, or transfer your rights or obligations under these Terms. If we fail to act with respect to your breach or anyone else's breach on any occasion, we are not waiving our right to act with respect to future or similar breaches. If a court finds any of these Terms to be unenforceable or invalid, that Term will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable. The headings in these Terms are for your convenience and reference; they do not limit or affect these Terms. These Terms, together with those items made a part of these terms by reference, make up the entire agreement between us relating to your use of our site, and replaces any prior understandings or agreements (whether oral or written) regarding your use of our site.
Provisions of these Terms and Conditions
These Terms supersede any prior Citycabpanama Terms and Conditions relating to the use of the Site that were displayed on this Site before the date stated above. Unless specifically provided, they do not supersede the Additional Terms for carriage, awards, attractions provided elsewhere in this Site.
